Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period (also referred to as Withdrawal Period): The time frame in which the consumer may cancel the agreement

  • Consumer: A natural person who is not acting for purposes relating to trade, business, or professional activities.

  • Day: A calendar day.

  • Ongoing Transaction: A distance contract relating to a series of products and/or services delivered over time.

  • Durable Medium: Any tool that allows the consumer or entrepreneur to store personal information in a way that makes it accessible in the future, unchanged.

  • Right of Withdrawal: The right of the consumer to cancel the contract within the cooling-off period.

  • Entrepreneur: Masculine Dynasty (LumaBulb), trading as LumaBulb.com.

  • Distance Contract: An agreement concluded via an organized system for selling products remotely, using one or more means of distance communication.

  • Means of Distance Communication: Any method used to conclude an agreement without being physically present (e.g., email, website, phone).

  • General Terms and Conditions: The present terms and conditions.

Article 3 – Applicability

These general terms and conditions apply to every offer, order, and contract made between LumaBulb.com and a consumer.

The terms will be made available to the consumer electronically and can be saved on a durable medium. By placing an order, the consumer agrees to these terms.

If separate product or service conditions apply, the consumer may invoke the most favorable clause in case of conflicting terms.


Article 4 – The Offer

  • Offers include clear product descriptions and pricing, including taxes.

  • Any limited-time offers or special conditions will be clearly stated.

  • Obvious clerical or typographical errors in pricing or product descriptions do not bind the entrepreneur
  • Images of products are intended to be accurate representations but may differ slightly due to screen display settings.

  • Product availability is not guaranteed until confirmed at checkout.


Article 5 – The Contract

  • A contract is concluded once the consumer places an order and receives confirmation.

  • In case of online purchase, confirmation is sent electronically.

  • The entrepreneur reserves the right to cancel any order if payment fraud or suspicious activity is suspected.

  • The entrepreneur will provide relevant product information and contact details upon or after delivery.


Article 6 – Right of Withdrawal

  • Consumers may withdraw from the contract within 30 days after delivery.

  • Notification of withdrawal must be sent in writing (e.g., email to info@lumabulb.com).

  • Returned items must be unused, in original condition and original packaging, including all supplied accessories.

  • Return shipping costs are borne by the consumer.

  • Returns must be shipped within 5 days of notifying withdrawal. Proof of shipment is required.

  • Refunds will be processed within 5 business days after return approval.

  • Returns must be sent at the consumer’s expense to the designated supplier address unless otherwise specified.

Exclusions:
No right of withdrawal for:

  • Custom-made or personalized lighting

  • Used, damaged, or modified items

  • Items returned outside the return window


Article 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal:

  • Return costs are paid by the consumer.

  • The initial payment will be refunded within 5 business days upon receiving the returned item in acceptable condition.

  • Refunds will only be issued once the returned item has been received in acceptable condition, or sufficient proof of return has been provided.

Article 8 – Exclusion of the Right of Withdrawal

Withdrawal is not possible for:

  • Customized lighting products made to consumer specifications

  • Items sealed for hygiene or safety reasons that have been unsealed

  • Products that are damaged due to incorrect installation

These exclusions will be clearly mentioned in the product description if applicable.


Article 9 – Pricing

  • Prices include VAT unless otherwise stated.

  • Shipping costs are calculated at checkout.

  • Prices may vary based on supplier changes or VAT rate fluctuations.

  • International customers are responsible for import duties, customs, and taxes.

  • No rights may be derived from pricing errors.


Article 10 – Compliance and Warranty

  • LumaBulb guarantees product conformity with descriptions and functionality for at least 2 years, as required by EU law.

  • Warranty claims must be reported within 30 days of discovering a defect, with proof.

  • Warranty excludes misuse, accidental damage, or improper installation.

  • LumaBulb reserves the right to repair, replace, or refund at its discretion.


Article 11 – Delivery and Execution

  • Orders are shipped promptly, typically within 1–5 business days, with estimated delivery between 5–14 business days.

  • Delivery delays will be communicated. If delivery is not possible within 30 days, the customer may cancel the contract.

  • Products are delivered to the address provided by the consumer.

  • The entrepreneur is not liable for delays or delivery failures caused by force majeure, customs, or courier services

  • Risk transfers upon delivery to the consumer or authorized recipient.


Article 12 – Duration Contracts, Termination & Renewal

  • LumaBulb does not offer subscription services or ongoing supply contracts at this time.

  • In the future, if applicable, consumers will be able to cancel duration-based agreements with one month's notice.


Article 13 – Payment

  • Payment must be completed before shipment via the provided secure checkout system.

  • The consumer is responsible for ensuring accurate billing information.

  • In the event of failed payment or fraud, the entrepreneur may cancel the order.

  • Late or reversed payments may be pursued via debt collection where legally allowed.


Article 14 – Complaints

  • Complaints must be submitted via email to info@lumabulb.com within 7 days of receiving the product or discovering a defect.

  • The entrepreneur will respond within 30 days with a resolution or further steps.

  • If no agreement is reached, the consumer may escalate the complaint via the EU ODR platform or Dutch court.

Article 15 – Disputes and Governing Law

  • All contracts are governed by Dutch law, even for international consumers.

  • Disputes will be submitted to the court in Arnhem, the Netherlands, unless otherwise mandated by EU law.

  • Consumers in the EU may use https://ec.europa.eu/consumers/odr for online dispute resolution.
